AASA Files Comments on Magnuson-Moss Warranty Act

RESEARCH TRIANGLE PARK, N.C. – On Oct. 24, 2011, the Automotive Aftermarket Suppliers Association (AASA) filed comments with the Federal Trade Commission (FTC) in response to an Aug. 23 Request for Comment on the Commission’s warranty-related interpretations under the Magnuson-Moss Warranty Act.

“The Magnuson-Moss Warranty Act is important to automotive aftermarket manufacturers and the independent aftermarket in the increasingly competitive market for automotive repair and maintenance,” said Steve Handschuh, AASA president and COO. “AASA joined this effort with the Motor & Equipment Manufacturers Association (MEMA) to comment on the Act on behalf of its full service aftermarket manufacturer members.”

“Overall, AASA believes that the Commission’s existing guidelines and rules interpret the Act in a fair and balanced manner,” Handschuh said. “However, AASA does believe that the Commission needs to take action when vehicle manufacturers fail to follow the requirements of the law and issue misleading statements about the implications of aftermarket repair for their vehicle warranty.”

AASA comments specifically focused on the section that prohibits the use of the vehicle warranty to tie-in the sale of parts in the automotive aftermarket.
